Therefore, any references in these Terms and Conditions to the "Sites" are meant to include any such products, services, information and communications from or with Falhouse Books. These Terms and Conditions apply to all users of the Sites, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content. By accessing or using the Sites or any information, products or services from or serviced by the Sites, you agree to be bound by and to comply with these Terms and Conditions.

Falhouse Books reserves the right to revise these Terms and Conditions at any time, without prior notice, and any such revisions to these Terms and Conditions are effective as of the date posted on the Sites. Your continued use of the Sites, and of Falhouse Books' products and services, shall serve as consent to any and all revisions to these Terms and Conditions. 

Permitted Use of the Sites

By agreeing to these Terms and Conditions you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.

Subject to these Terms and Conditions, Falhouse Books grants you a limited, non-exclusive, non-transferable, non-sublicensable right to access and use the Sites (and to download, install and run our mobile applications solely on your personal mobile devices) for the purpose of learning about Falhouse Books' products and services, ordering products and services from Falhouse Books, communicating with Falhouse Books' Sales, Customer Support and otherwise accessing and using any functionality, information and services made available by Falhouse Books through the Sites. Falhouse Books retains and reserves all of its rights in the Sites and, except as expressly provided above, no rights or licenses in or to the Sites or any other intellectual property of Falhouse Books are granted or provided, hereunder, by implication, estoppel or otherwise.

The Sites may not be used for purposes that are in violation of any applicable laws or regulations or contrary to these Terms and Conditions. Furthermore, you agree not to (and shall have no right to): (i) reverse engineer, disassemble, decompile, modify, or create derivative works of or based on the Sites or any other part of the Sites or Falhouse Books's products or services; (ii) license, sell, rent, lease, transfer, assign, distribute, host or otherwise commercially exploit the Sites; (iii) upload, transmit or distribute any computer viruses, worms, malware or any other software intended to damage or alter any software, data, computer, device or communications network (collectively, "Malware") in connection with your use of or access to the Sites; or (iv) remove, obscure or alter any proprietary rights notices (including copyrights and trademark notices) that may be contained in, or displayed in connection with, the Sites or Falhouse Books' products or services.

If you post any content, comments or other communications on the Sites, or use Falhouse Books' products or services, you agree that you will not engage in any behavior that: would be construed as abusive, bullying, or harassing or is used to otherwise intimidate or threaten; contains profanity or cursing; is discriminatory (including, but not limited to, references of protected characteristics) or otherwise includes hateful speech, hateful symbols, hateful gestures or a message maligning or targeting a group of people; contains pornographic or obscene content; contains false or misleading information; contains commercial or political solicitations or slogans; takes the form of unsolicited repetitive communications (otherwise termed "spam"); is infringing or injurious to others; or is otherwise unlawful or objectionable in any manner.

You agree that content you contribute to the Sites will not contain any malware, viruses, spyware, or any other form of software designed to infiltrate or damage a computer system without the owner's informed consent.

Falhouse Books reserves the right in all cases to remove, edit, or block your postings or to terminate your access to our Sites, including if you violate any of the above restrictions. Falhouse Books does not continuously and uninterruptedly monitor, respond, or engage with all postings on the Sites at all times. However Falhouse Books will, from time to time, take voluntary action in good faith to restrict access to or availability of content or material that could be construed, in our discretion, as "potentially harmful" as outlined above (e.g., abusive, bullying, or harassing, etc.). At our discretion, Falhouse Books may provide reasonable notice of violations of these Terms and Conditions and what we have deemed an appropriate consequence (including, but not limited to: removing content, blocking or banning a user, notifying law enforcement, etc.). However, Falhouse Books reserves all rights to remove content or terminate your access to our Sites without notice where we, at our sole discretion, deem reasonable or appropriate. Falhouse Books takes no responsibility and assumes no liability for any content or material posted by anyone who uses our Sites. Content not posted by Falhouse Books has not been vetted or approved by Falhouse Books, and should not be considered endorsed by Falhouse Books.

By posting to the Sites or otherwise uploading or providing any information, photos, images, audio, video or other content, you give Falhouse Books a worldwide, royalty-free, sublicensable, perpetual and irrevocable right to copy, use, reproduce, publish, display, distribute, modify, exploit and create derivative works of such content, subject to any applicable terms of our Privacy Policy. 

Should you, at our request, send specific submissions (for example contest entries) or without our request, send creative ideas, suggestions, proposals, plans, or other materials, whether online, by email, by postal mail, or otherwise (collectively, 'comments'), you agree that we may, at any time, without restriction, edit, copy, publish, distribute, translate and otherwise use in any medium any comments that you forward to us. We are and shall be under no obligation (i) to maintain any comments in confidence; (ii) to pay compensation for any comments; or (iii) to respond to any comments.

Falhouse Books reserves the right to refuse service or the sale of products, to edit or remove content from the Sites, or to discontinue or cancel any transaction or order or service, at its sole discretion and at any time, with or without notice to you or any other person, consistent with applicable law.

In the event that Falhouse Books make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. Falhouse Books reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors. 

You agree to provide current, complete and accurate purchase and account information for all purchases made at our Sites. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed. Falhouse Books reserves the right, without undertaking an obligation, to submit any information provided by you, without subpoena, to law enforcement agencies and/or any credit card or other financing company for fraud investigation. Falhouse Books reserves the right to cooperate with authorities to prosecute such offenders to the fullest extent of the law.

The Sites contains links to other websites that have information we believe may be of interest. We do not endorse these sites and are not responsible for any of the content contained therein or any information that may be collected from you in visiting such sites.

Disclaimer of Warranties

Falhouse Books do not guarantee, represent or warrant that your use of the Sites or their content, including any communications with Falhouse Books personnel, will be uninterrupted, timely, secure or 100% error-free. Falhouse Books do not warrant that the results that may be obtained from the use of the Sites will be accurate or reliable. You agree that from time to time we may remove the Sites and products for indefinite periods of time or cancel the Service at any time, without notice to you.

You expressly agree that your use of, or inability to use, the Sites and all products is at your sole risk. The Sites and all products and Services delivered to you through the Sites are (except as expressly stated by us) provided “as is” and 'as available' for your use, without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement. To the maximum extent permitted by applicable law, in no event will Falhouse Books be liable for any indirect, special, consequential, exemplary, incidental or punitive damages of any kind in connection with these terms and conditions or in connection with your access to or use of the Sites or your purchase or use of any products, services or information from Falhouse Books, including without limitation any failure of, or error in performance of the Sites or any such products or services. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, the liability in such jurisdictions, shall be limited to the full extent permitted by the relevant law.

You understand that your content (not including credit card information), may be transferred unencrypted and involve (i) transmissions over various networks; and (ii) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks.

Copyrights and Other Intellectual Property

Falhouse Books retains all of its ownership and other rights in and to any copyrightable material contained on the Sites or in its products as well as in and to any other intellectual property and technology of Falhouse Books. No rights or licenses are granted by Falhouse Books hereunder, by implication, estoppel or otherwise, except to the limited extent expressly stated herein. You have no rights to and you agree not to (i) copy, publicly display, sell, post or transmit the Sites, our products or any portion thereof; or (ii) interfere with, disrupt or attempt to gain unauthorized access to the Sites. Notwithstanding the foregoing, you may make one copy of material displayed on the Sites for your own personal and noncommercial use only, which may not be distributed to others without written permission from Falhouse Books. You shall immediately notify us upon learning of any violation of the restrictions or limitations specified in these Terms and Conditions.

Trademarks

"Falhouse Publishing", "Falhouse Books", the Falhouse logo trademarks used on the Sites are trademarks of Falhouse Publishing, LLC. You may not use or display any of the foregoing without prior written consent. Unauthorized use of the foregoing trademarks may be a violation of the applicable trademark laws.

Information Collected on the Sites

Subject to the terms and conditions of our Privacy Policy, information collected on or through the Sites is owned by Falhouse Books, and therefore we may disclose or sell such information; for example, in conjunction with the sale of our company or a portion of our assets.

Products and Services

Prices for our products are subject to change without notice. Falhouse Books reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time. Falhouse Books shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.

Certain products or Services may be available exclusively online through the website. These products or Services may have limited quantities and are subject to return or exchange only according to our Refund Policy.

Falhouse Books have made every effort to display as accurately as possible the colors and images of our products that appear at the store. We cannot guarantee that your computer monitor's display of any color will be accurate.

Falhouse Books reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. Falhouse Books reserve the right to limit the quantities of any products or Services that we offer. All descriptions of products or product pricing are subject to change at any time without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. Any offer for any product or Service made on this site is void where prohibited.

Falhouse Books do not warrant that the quality of any products, Services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.

Optional Tools

Falhouse Books may provide you with access to third-party tools over which we neither monitor nor have any control nor input. Occasionally there may be information on our site or in the Service that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability. Falhouse Books reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information in the Service or on any related website is inaccurate at any time without prior notice (including after you have submitted your order).

Falhouse Books undertake no obligation to update, amend or clarify information in the Service or on any related website, including without limitation, pricing information, except as required by law. No specified update or refresh date applied in the Service or on any related website, should be taken to indicate that all information in the Service or on any related website has been modified or updated.

Indemnify

You agree to indemnify, defend and hold harmless Falhouse Books and our subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, Service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms and Conditions or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

Entire Agreement

The failure of Falhouse Books to exercise or enforce any right or provision of these Terms and Conditions shall not constitute a waiver of such right or provision. These Terms and Conditions, and any policies or operating rules posted by us on Sites or in respect to the Service constitutes the entire agreement and understanding between you and Falhouse Books and governs your use of Sites, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and Falhouse Books (including, but not limited to, any prior versions of the Terms and Conditions). Any ambiguities in the interpretation of these Terms and Conditions shall not be construed against the drafting party.

Governing Law

These Terms and Conditions and any separate agreements whereby Falhouse Books provide you Services shall be governed by and construed in accordance with the laws of the United States.

Opt-out Procedures

To elect not to receive future email marketing communications from Falhouse Books, send an email to support@falhousebooks.com. You will be provided the opportunity to opt out of marketing communications at the end of marketing emails, and can opt out of SMS text messaging by replying "STOP". Note that Falhouse Books will continue to send you emails about your orders, recalls, and other commercial issues deemed necessary, even if you have opted out of marketing communications. 

Standard Return Policy

Falhouse Books does not accept returns or exchanges on products purchased on Sites. If you have received a damaged or defective product, please contact us at support@falhousebooks.com, within 24 hours of delivery, with proof of damage/defect in order to receive a replacement product.
